By accessing or using TriTalk's AI-powered language learning platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Service. These Terms apply to all users, including visitors, registered users, and subscribers.
2. Description of Service
TriTalk is an AI-powered language learning platform that enables users to practice speaking through interactive conversations with AI tutors. Our Service includes:
- Real-time voice conversation practice with AI companions
- Instant pronunciation feedback and correction
- Grammar and vocabulary analysis
- Pre-built conversation scenarios for various real-life situations
- Custom scenario creation tools
- Progress tracking and learning analytics
- Personalized learning recommendations
3. User Accounts and Registration
3.1 Account Creation
To use certain features of TriTalk, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate and current.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
3.3 Age Requirements
You must be at least 13 years old to use TriTalk. Users under 18 should have parental or guardian consent. We reserve the right to request proof of age at any time.
4. Acceptable Use
When using TriTalk, you agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Harass, abuse, or harm other users or our AI systems
- Attempt to reverse engineer, decompile, or extract our AI models
- Use automated systems (bots, scrapers) without authorization
- Share your account with others or create multiple accounts
- Upload harmful content, malware, or viruses
- Interfere with or disrupt the Service or servers
- Collect or store personal data about other users
- Use the Service to train competing AI models
5. Subscription and Payments
5.1 Free and Paid Plans
TriTalk offers both free and paid subscription plans. Free plans have limited features and usage quotas. Paid subscriptions provide unlimited access to all features, including advanced scenarios, detailed analytics, and priority support.
5.2 Billing and Renewal
Subscriptions automatically renew unless cancelled before the renewal date. You will be charged at the beginning of each billing cycle. Prices are subject to change with 30 days' notice. No refunds are provided for partial subscription periods.
5.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
6. Intellectual Property Rights
6.1 TriTalk's Rights
All rights, title, and interest in TriTalk, including our AI models, algorithms, software, designs, logos, and content, are owned by TriTalk Inc. You may not copy, modify, distribute, or create derivative works without express written permission.
6.2 Your Content
You retain ownership of any content you create or upload, including custom scenarios. By using TriTalk, you grant us a license to use, store, and process your content to provide and improve our Service. This includes using anonymized learning data to train our AI models.
6.3 Feedback
If you provide feedback, suggestions, or ideas about TriTalk, we may use them without any obligation to you. You grant us a perpetual, royalty-free license to implement and commercialize such feedback.
7. AI Technology and Limitations
TriTalk uses advanced AI technology to simulate conversations and provide feedback. However, you acknowledge that:
- AI-generated responses may occasionally be inaccurate or inappropriate
- Pronunciation and grammar feedback are automated and may contain errors
- TriTalk does not replace professional language instruction or certification
- AI conversations are simulations and do not guarantee real-world proficiency
- The Service is an educational tool, not a professional translation service
8. Privacy and Data Usage
Your privacy is important to us. Our collection and use of personal information, including voice data, is governed by our Privacy Policy. By using TriTalk, you consent to the collection and processing of your data as described in the Privacy Policy. We use voice recordings to provide feedback and improve our AI models.
9. Disclaimers and Limitations of Liability
9.1 Service Availability
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure access. We may modify, suspend, or discontinue any part of the Service at any time.
9.2 No Warranty
We make no warranties about the accuracy, reliability, or effectiveness of our language learning tools. Results may vary based on individual effort and ability.
9.3 Limitation of Liability
To the maximum extent permitted by law, TriTalk shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the past 12 months.
10. Indemnification
You agree to indemnify and hold harmless TriTalk, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of others.
11. Termination
We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or other reasons at our discretion. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through your account settings.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of TriTalk after changes constitutes acceptance of the modified Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in San Francisco, California, except where prohibited by law. You waive any right to participate in class action lawsuits.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. The unenforceable provision will be modified to reflect the parties' intentions as closely as possible.
